Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days

• for contracts for services (maintenance contract) and for the delivery and installation of an air conditioner, from the day the contract is concluded,
• for the purchase of units without installation, from the day on which you or a third party named by you, other than the carrier, took possession of the goods (for several goods delivered separately: the last item).

To exercise your right of withdrawal, you must inform us (369 Vision Werk GmbH & Co. KG, Südstraße 16, 38536 Meinersen, telephone +49 5372 474998-0, e-mail info@369visionwerk.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we must refund all payments we have received from you, including any delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal. For this refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund.
Goods: We may withhold the refund until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is earlier. You must return or hand over the goods to us (369 Vision Werk GmbH & Co. KG, Ausbüttel premises, address as in the order confirmation) without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you send or bring the goods before the period expires. You bear the direct costs of returning the goods; for air-con units that cannot normally be sent by post because of their weight, we estimate these costs at a maximum of about 150 € per unit. You only have to pay for any loss in value of the goods if this loss is due to handling them in a way that was not necessary for checking their nature, characteristics and functioning – this applies in particular to units that have already been installed or filled with refrigerant.
Services and installation: If you requested that the services or installation begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us that you are exercising the right of withdrawal with regard to this contract, compared with the full scope of the services provided for in the contract.

Special notes

In the case of a contract for services, the right of withdrawal expires when we have fully provided the service and only began performing it after you gave your express consent and at the same time confirmed your acknowledgement that you lose your right of withdrawal once we have fully performed the contract.
